Terms of Use for HomeBuyerLeads

Welcome to HomeBuyerLeads, a service operated by Roboteer Automation Limited (“we,” “us,” “our”). By subscribing to and using our services available on www.homebuyerleads.co.uk (the "Website"), you agree to the following terms and conditions (“Terms of Use”). Please read these Terms of Use carefully before subscribing to or using our services.
1. Subscription and Payment Terms
1.1 Account Setup
Your account details will be provided via email to you immediately after signing up to HomeBuyerLeads.
You must ensure your postcode districts are available before signing up. We have methods to prevent this, however if you have selected postcode districts that are unavailable, we reserve the right to substitute these with nearby postcode districts at our discretion.
1.1.1 API Key Security
As part of using HomeBuyerLeads, you may need to provide your Stannp API key if you wish to send letters via our Stannp integration. Please note:
- Your API key is stored in encrypted format in our secure database
- You should never share your API key with anyone, including employees of Roboteer Automation Limited
- If you suspect your API key has been compromised, you should immediately generate a new one in your Stannp account and update it in HomeBuyerLeads
- We are not responsible for any unauthorised use of your API key if you have shared it with others
1.1.2 Using the Stannp Integration
We have integrated with Stannp to allow you to send letters directly from HomeBuyerLeads. Please note:
- We are not responsible for any letters sent via the Stannp integration
- We are not able to provide any support for an existing Stannp integration or any letters sent via the Stannp integration
- Stannp is a third party service and you require your own account with them to use the integration
- If you require assistance setting up the Stannp integration, we offer setup assistance calls that last up to 30 minutes and are charged at £100.
1.2 Free Trial Period
New users are eligible for a 14-day free trial of HomeBuyerLeads. During the trial period:
- You will only have access to property data for homes sold more than 6 months ago
- You can test all features of the platform with this historical data
- No payment will be taken during the trial period
You may choose to end your trial early to access all property data, including recent sales. Doing so will:
- Immediately activate your paid subscription
- Trigger your first payment
- Grant you full access to all property data regardless of sale date
1.3 Monthly Rolling Subscription
All services provided by HomeBuyerLeads are based on a monthly rolling subscription, which automatically renews on the same date each month unless canceled by either party.
You may cancel your subscription at any time from within the application and will be issued a pro rated refund for any unused portion of your current billing period if applicable.
You may add or remove postcode districts at any time within the application. If you add new postcodes, you will be charged the difference immediately. If you remove postcodes, the new price will be reflected in your next billing cycle.
The subscription fee will be billed via Stripe on a monthly basis.
1.3 Billing
All payments are due at the start of each billing cycle and will be automatically collected via a Stripe subscription.
Failure to pay the subscription fee may result in suspension or termination of your access to the HomeBuyerLeads service.
2. Cancellation and Termination
2.1 Cancellation by You
You may cancel your subscription at any time from within the application. Upon cancellation:
- Your account will be closed immediately
- You will receive a pro-rated refund for any unused portion of your current billing period
2.2 Cancellation by Us
We reserve the right to suspend or terminate your subscription at our discretion if:
- You breach these Terms of Use
- You fail to make payment when due
- We suspect fraudulent or abusive activity
- We cease operations or discontinue the service
In the event we terminate your subscription, you will receive a pro-rated refund for any unused portion of your current billing period, unless the termination is due to a breach of these Terms of Use or fraudulent activity.
3. Refunds
3.1 Immediate Refund (self service within the application)
You are eligible for a full refund if all of the following conditions are met:
- You have only made one payment to HomeBuyerLeads
- You have downloaded or sent fewer than 10 letters
- You request the refund within your first billing period
If you qualify, the refund will be processed immediately and your account will be closed.
No refunds will be issued for postage costs already incurred.
3.2 Refund Policy for Subscription Cancellations
When you cancel your subscription, we calculate refunds on a pro-rata basis for any unused time in your current billing period. Here's how it works:
- We look at how many days are remaining in your current billing period when you cancel
- We calculate this as a percentage of the total billing period
- We then apply this percentage to any payments you've made during the current billing period
For example:
- If you're halfway through a 30-day billing period when you cancel, you'll receive approximately 50% of your payment(s) back
- If you've made multiple payments in the same billing period (e.g., if you added more postcodes), each payment will be refunded proportionally based on the remaining time
Example with multiple payments:
Let's say you have a 30-day billing period and:
- You paid £60 at the start of the period
- You added more postcodes 10 days later and paid an additional £30
- You cancel with 15 days remaining
Your refund would be:
- For the first payment: £60 × (15/30) = £30
- For the second payment: £30 × (15/30) = £15
- Total refund: £45
Refunds typically appear in your account within 5-10 business days of cancellation. The exact refund amount will be confirmed in your cancellation email.
Note: Trial periods are not eligible for refunds. If you cancel during a trial period, you will not be charged, and no refund will be issued.
4. Modifications to Services and Fees
4.1 Changes to Postcode Coverage
4.1.1 Minimum Coverage
- Subscribers must maintain at least one (1) postcode district at all times
- Attempts to remove all postcode districts will be rejected
4.1.2 Adding Postcode Districts
- Additional postcode districts can be added at any time during your subscription period
- Charges for additional postcodes will be prorated and billed immediately
- New postcode districts must be available and not already assigned to another contractor of the same type
- All postcode additions are subject to immediate payment
4.1.3 Removing Postcode Districts
- Subscribers may remove postcode districts at any time
- Removed districts will remain active until the end of the current billing period
- No refunds will be issued for removed postcode districts to prevent abuse of the platform
- Changes will be reflected in the next billing cycle
4.1.4 Billing Adjustments
- Adding postcodes will trigger an immediate prorated charge
- Removing postcodes will adjust the subscription cost from the next billing cycle
- All prices are in GBP and include applicable taxes
4.1.5 Notifications
Email confirmation will be sent for all postcode coverage changes, including:
- Details of added and/or removed postcodes
- Updated total postcode count
- Next invoice amount
- Next billing date
4.1.6 Restrictions
- You can only add postcode districts that are not currently assigned to another contractor of your type
- You must maintain at least one active postcode district
- All changes are subject to system availability and validation
4.1.7 Service Continuity
- Changes to postcode coverage do not affect your base subscription status
- Your subscription must be active to make any changes to postcode coverage
4.2 General Modifications
We reserve the right to modify or discontinue any aspect of the HomeBuyerLeads service at any time, with or without notice.
We may change subscription fees and you will be notified in advance of any such changes. Your continued use of the service following such changes will constitute your acceptance of the new fees.
5. Data Availability, Refresh and Quality
5.1 Availability of Product Data
While we strive to provide accurate and comprehensive property data, including Energy Performance Certificate (EPC) records, we cannot guarantee the availability of EPC data for all properties listed on our platform.
The availability of EPC data is subject to various factors outside of our control, including but not limited to:
- The existence or non-existence of EPC records for individual properties
- The accuracy, completeness, and timeliness of data provided by external sources, including public and private databases
- Restrictions or changes in access to third-party data sources
As a result:
- Some properties listed on our platform may not have any associated EPC records
- Where EPC data is provided, we do not guarantee its accuracy, completeness, or relevance to the user's specific requirements
- Users are advised to independently verify EPC data directly with relevant official sources where it is critical to their purposes
- By using our platform, you acknowledge and accept these limitations, and you agree that we shall not be held liable for the absence of EPC data for any property or for any decisions made based on the data provided
5.2 Data Quality and Updates
Our property data is updated regularly through various sources, but there may be inherent delays or discrepancies:
- Property sale data typically has a delay of 4-6 weeks from the actual sale date
- EPC data updates may be delayed through no fault of our own
- Address information is sourced from multiple providers and may occasionally contain inconsistencies
We implement the following measures to maintain data quality:
- Regular automated data validation and cleaning processes
- Cross-referencing between multiple data sources where possible
- Removal of duplicate or clearly incorrect entries
- Manual review of reported data discrepancies
Users should note that:
- Historical data may be incomplete or less reliable
- Property details should be verified before any significant business decisions
- Any suspected data inaccuracies should be reported to our support team
6. Limitation of Liability
To the fullest extent permitted by law, Roboteer Automation Limited shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the HomeBuyerLeads service.
7. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
8. Data Sources and GDPR Compliance
8.1 Property Data Sources
The property data provided through HomeBuyerLeads is sourced from publicly available records and enriched through private/commercial data providers, specifically:
- HM Land Registry's Price Paid Data, which is updated monthly and contains information about property sales in England and Wales. This does not include the address of the properties.
- A private/commercial data provider for address information and additional property data.
- EPC data from the government's EPC Register which we are allowed to use to promote services to enhance energy efficiency of properties.

8.2 Data Protection and GDPR Compliance
In accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Data Protection Act 2018 ("DPA"), we hereby confirm that property addresses and Energy Performance Certificate (EPC) data do not constitute personal data as defined under Article 4(1) of the GDPR. Notwithstanding this, we maintain strict compliance with all applicable data protection legislation:
- We do not process, store, or have access to any personally identifiable information relating to the properties on our platform, including but not limited to names, of property occupants or owners
- Data subjects (users of our platform) retain the right to account deletion, which can be exercised through the self-service subscription cancellation mechanism
- In accordance with Article 15 of the GDPR, data subjects may exercise their right of access by submitting a request to hello@roboteer.co.uk
- Pursuant to Article 32 of the GDPR, we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk
- We maintain active registration with the Information Commissioner's Office (ICO) under registration number ZB606157, in compliance with Section 123 of the DPA
Users of our service assume the following legal obligations and responsibilities:
- Compliance with all applicable data protection legislation, including but not limited to the GDPR and DPA
- Maintenance of records of processing activities as required under Article 30 of the GDPR
- Immediate implementation of opt-out requests in accordance with Article 21 of the GDPR
- Restriction of data usage exclusively to legitimate direct marketing purposes related to property energy efficiency improvements, as permitted under Article 6(1)(f) of the GDPR
